ON A PROPOSED LOCAL LAW
OF THE TOWN OF BALLSTON,
AS SET FORTH HEREIN
LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 20 of the Municipal Home Rule Law of the State of New York, and pursuant to a resolution of the Town Board of the Town of Ballston, adopted October 8, 2019, the said Town Board will hold a public hearing at the Town Hall, 323 Charlton Road, Ballston Spa, NY, on the 7th day of November 2019 at 5:45 p.m., to accept any report of the Zoning Board of Appeals pursuant to the Town of Ballston Code Section 138-96 and hear all interested parties and citizens regarding the adoption of proposed Local Law 2 of 2019 titled “Amending the Town Code - Chapter 138 Zoning and Chapter 104 Subdivision of Land”. Said hearing may be adjourned from time to time as necessary. Further information of said proposed Local Law may be obtained at the Town Clerk’s Office, 323 Charlton Road, Ballston Spa, NY 12020 or at www.townofballstonny.org

BNU has been contacted by several concerned residents over the proposed zoning changes and the current Supervisor's disregard to the resident comments at the March 12, 2019 Town Wide Public Hearing.  (you will find a link to a video recording of that hearing at the bottom of this post)

The majority of three board members continue to leave our town vulnerable to rampant over-development, apartment buildings, condos, our wetlands are at risk with no buffer zones to protect them, this new proposed zoning even REMOVES buffers to farmland,  encroaching into our most valued asset - the rural character of Ballston.
Rumors have been surfacing that the Supervisor is trying to push through his agenda before the his elected term ends.    Below please read this response from Council Member Candidate Peter Solberg:

"As we continue our involvement in town government by attending various meetings and initiatives, there is a flurry of activity in the planning board regarding ongoing development efforts.   One item of special note is the activity at the town board level regarding the proposed zoning.   The current town's leadership has devoted much effort toward completing and implementing zoning changes.  

The zoning package presented for a vote this coming October 8th is a culmination of various authors, revisions, and initiatives.    In my opinion concurred by my running mates Eric Connolly and Chuck Curtiss,  the proposed zoning legislation represents the good, the bad, and the ugly.    The zoning that is currently active within the township is flawed and, in many forms, does not align with the intent of the comprehensive plan.   It provides a wide variation of uses and freedoms that are in direct contradiction with the will of the residents.   The new zoning package has been a long-awaited effort to try to close these gaps and provide guidance and restrictions on how we wanted our town to be developed.   Many people provided input either in workshops, verbally, or in written form.   It is unfortunate that this legislation is the result of such labors because in many aspects it does not reflect the will of the people who worked so tirelessly to close those gaps.   It is easier to state who would enjoy the new regulations and policies included in this proposed zoning than to state who is opposed.   However, a list of opposition includes those who support smart growth, farmland protection, historical preservation, and watershed and environmental protections.   Those in support include land owners of special interests with intent to develop their investments regardless of the outcome.   The lack of transparency within this process has eluded participants within the town government and those who are heavily involved with town activities.   It again is sad when participants from the ZBA (Zoning Board of Appeals) were unaware of and do not understand the legislation that is being enacted.   Multiple resident FOIL requests do not clarify the journey that this legislation has made across leadership's "desk".   I can assure all residents that when and if the leadership of Connolly, Curtiss and Solberg is sworn into the Ballston Town Board, there will be continued efforts to right the ship.   To correct the inaccuracies and injustices that are in both the current and proposed zoning.   That those involved in the workshops and public hearings will have a voice.   That professional and certified staff will execute the required process to enact and implement zoning amendments.   

This proposed zoning legislation is not something that the current leadership should be proud of.   In fact, they should be ashamed of the disservice they have done.  I suggest all residents take the time to read the proposed changes and participate at the upcoming meeting should they wish to voice concern like we have."           -Peter Solberg Charlton Road, Ballston
