Town of Ballston Sewer Committee Monthly Meeting
notes taken by a town resident on October 2nd, 2018


Committee member in attendance were; Jim DiPasquale, Wes DeVoe, William Goslin, Drew Hamelink, Ed Hernandez, and Kim Kotkoskie.


Other guests & observers present were; Ruth Osterlitz, Norm Schulthieiss, and Carl Thurnau.

Ballston Lake Sewer Financial

Financial was not handed out. Kim K. informed it was on-line for the committee.

Ianniello Andersen contract additional $50k will be added and the new Eminent Domain Attorney Trainor contract will be added. (amount not disclosed)

Ballston Lake Sewer Legal Update

Eminent Domain Legal
There are now 17 parcels on the list. One on the list, Kim would like some help from Ed H. – it is a family sub-division. They want to sign but sure where the pipe will be in the mapping and which person should do the signing. Kim will meet with the lawyer after the hearing and go over each property, so they are not spending more on legal fees than necessary. Five of the parcels are in Clifton Park and CP will be monitoring our hearings and activities.

Sewer Use Law
Law has been adopted by the Town. The final Sewer Use Law is posted on the Ballston Sewers website.

Project Legal
The town board has approved to add an additional $50,000. to the Ianniello Andersen contract (Project Lawyer Bruce Steves) to provide legal services to the point of construction.

Ballston Lake Sewer Grant Money

The Town Board scheduled a public hearing to consider an increase in the maximum amount proposed to be expended for the project from $10.20 MM (originally authorized by the Map, Plan and Report) to $12.75 MM. The increase will allow for inclusion of a $2.55 MM New York State Water Grant received by the project into the maximum amount proposed to be expended. Although the maximum amount proposed to be expended would increase, the anticipated cost to a typical property will decrease from $907 per year as communicated in the 2015 Map, Plan & Report. Even if the project costs were to reach the maximum allowed by the proposed increase, that being $12.75 MM, the anticipated annual cost to the typical property would be $870, which is still $37 per year less than the amount stated in the Map, Plan and Report. This update, and associated public hearing, is recommended to occur at this time prior to releasing the project for bid to allow for flexibility and prevent delays in awarding a contract.

The following has occurred since the 2015 vote that has contributed to this update:

I. Construction costs have steadily risen each year. It is anticipated that we may receive construction bid prices higher than those originally budgeted for in the 2015 Map, Plan and Report. Exact pricing is not known at this time. Several projects within the New York State Clean Water State Revolving Fund program are experiencing similar cost increases. By anticipating the increase in advance to set an allowable, not to exceed ceiling amount, it will prevent delays in contract award and also lower costs long term by not delaying construction.

II. The Town of Ballston received a $2.55 MM Clean Water Grant that was not known at the time of the 2015 vote. This grant is expected to entirely offset the rising construction costs, and still allow for reduced annual payment amounts for parcel owners within the District. Further detailed information regarding expected costs will not be known until bids are received. The public hearing is set for October 9th at 6:15 PM.

Carl T. raised his concerns that back in 2015 the town was promising that if they received a grant it would make their payments go down and people are expecting the grant money is reduce the cost of the project not be added to the cost of the project.

Parcel Query Update

The sewer district is constantly changing in EDUs. The assessor’s office has run a query and the results as of now is that there have been lots of changes since 2015 but overall the EDUs have only increased by 2.5 additional EDUs.
