was not handed out. Kim K. informed it
was given on-line for the committee.

Legal Update
Eminent
Domain Legal
There
are now 13 parcels on the list. Four of the parcels are in Clifton Park and CP
will be monitoring our hearings and activities.
Atty
Trainor is $225. per hour for emanate domain portion of the project
Sewer
Use Law
The
final Sewer Use Law is posted on the Ballston Sewers website and it became effective
October 1, 2018. Now we have received a
new comment on the law. Kim K. has spoke
with Atty Bill and Tim about this already.
New
Comment: The
Lake Road residences submitted a comment to the draft law back when we had a
public hearing. The format is which they submitted it was; Anyone which is not
is the waterfront district should not be required to connect. As a group we determined there are other
contributors that are not in the waterfront, but they are in the
watershed. Now the person than said that
they did not understand why their comment has not taken since they are not in
the watershed. Kim K. informed the
person that was not what was said in the comment. Kim then checked the data on the properties,
they are around borderline upper 200 feet from the sewer and the smallest
property is a little over 3 acres, they are down stream and almost qualify for
the distance connection but do not. Kim
would like to know how the group felt if they were exempt until failure. Open discussion included; they are not in the
watershed. they would still have to pay the debt service, Drew & Jim both
said no exemption should be given. Ed H.
comment was barely audible. He did not
think any specific properties should be exempt, a new exemption description
would have to be added to exempt a property.
If the Town board asks
this committee for a recommendation, Kim will report to the board that the
Sewer Committee thinks there are already too many exemptions and could be
unfair to do this. However, these homes
have large parcel sizes and they are not in the watershed.
Parcel Query Update
The
sewer district is constantly changing in EDUs. This month’s update is that Clifton
Park went down by 2 EDUs. One is an Ag exemption and the other is an
unbuildable lot.
Hoping
to go out for bid end of 2018 - January 2019.
